Our panel will explore how businesses investing capital overseas can optimise the value and return of their foreign investments, including upfront risk analysis, investment strategy and structuring, use of political risk insurance and effective use of investment arbitration.

Matt Lee Headshot Image

Matt Lee | (formerly Principal, Burford Capital)

Matt Lee was formerly the Principal responsible for Burford Capital’s investments and operations in Australia. His focus is on assisting Australian businesses with legal finance for high-value commercial arbitrations and litigation as well as enforcement campaigns for legal disputes that are regularly multi-jurisdictional in nature. Prior to joining Burford, Matt was responsible for managing cases in the international dispute resolution team at a global law firm based in New York.

Shanna Svensson | Team Lead, Global Litigation Asia Pacific, Shell

Shanna Svensson is Senior Legal Counsel in Shell’s Global Litigation group and leads the team managing Shell’s material litigation across Asia Pacific. She joined the Shell group in 2016, having managed BG Group’s Australian litigation and arbitration matters since 2013.  Prior to moving in-house Shanna practiced in the Construction & Major Projects Disputes team at Allens Linklaters, having graduated from Queensland University of Technology.

Recently she has supported Shell’s Australian QGC LNG, North West Shelf and Prelude integrated gas assets, including successfully defending a number of material international arbitration claims. During her time at Shell, Shanna has also supported litigation in the Europe, Middle East and North Africa region defending some of the most material cases for the Shell group, including in relation to climate change and corporate separateness.

Katie Chung | Partner Norton Rose Fulbright Singapore

Katie Chung is an international disputes and arbitration lawyer based in Singapore. With more than a decade of experience, Katie has advised and represented both private and state-owned clients in international arbitrations conducted under all major institutional and ad hoc arbitration rules. These disputes usually feature an Asian element, and involve a wide range of applicable laws and multijurisdictional parallel court proceedings.

Katie has extensive contentious experience in commodities, oil and gas, renewable energy and the power sector, and regularly advises on technology related disputes. She has also practised in Hong Kong and was seconded to an international oil major in Hong Kong. Katie acts as lead counsel in international arbitrations, and regularly sits as an arbitrator, having accepted appointments in institutional arbitrations seated in Singapore or Hong Kong under the ICC, SIAC and HKIAC Rules. She is on the reserve panel of arbitrators of the Singapore International Arbitration Centre (SIAC), the List of Arbitrators of the Hong Kong International Arbitration Centre (HKIAC), the Panel of International Arbitrators of the Korean Commercial Arbitration Board (KCAB) and the Panel of Arbitrators of the Thailand Arbitration Centre (THAC).

Dylan McKimmie | Head of Arbitration and Co-Head of Energy, Norton Rose Fulbright Australia

Dylan McKimmie is an arbitration partner with a national and international practice focussing on the energy sector, particularly the oil and gas sector where he works with several global oil and gas majors. With his in-depth understanding of both his clients and the industries in which they operate, Dylan provides reliable, technically-astute and commercially-focussed advice on issues across both upstream and downstream operations.

Described by clients as "pragmatic and outcome-driven" and "exceptional in terms of providing commercial advice, understanding business and understanding that everyone is trying to look for ways to reduce exposure to risks", Dylan's practice covers a wide range of commercial disputes, and he is the leader of NRFA’s "very capable and well-regarded arbitration team". Dylan has appeared as counsel in the High Court of Australia in one of the leading cases about international arbitration, and is ranked by Chambers, and by Best Lawyers in litigation (2013-2024), alternative dispute resolution (2014-2022), international arbitration (2016-2024) and competition law (2017-2024).

Ananya Mitra | Senior Associate, Norton Rose Fulbright Australia

Ananya Mitra is an international arbitration lawyer based in Sydney and is a Fellow of the Singapore Institute of Arbitrators (SIArb). Her practice includes complex commercial arbitration with a focus on the energy sector (piped gas, LNG, renewables). Ananya has acted for clients in Asia and Europe in a number of high value energy disputes including price reviews.

Chester is Professor of International Law and International Arbitration at the University of Sydney Law School, a barrister at 7 Wentworth Selborne Chambers, Sydney, and an Overseas Member of Essex Court Chambers, London.  His practice focuses on international arbitration, and encompasses advisory work and appearances in court and before arbitral tribunals.  He has particular expertise in disputes which raise issues of public and private international law, and he is presently engaged in a number of disputes arising under bilateral and multilateral investment treaties.

Jo Feldman is a dispute resolution partner who has represented clients in commercial and treaty arbitrations. She has worked for governments and claimants, on some of the largest arbitrations in the world including the tobacco plain packaging disputes against Australia, Ukraine and sanctions disputes, human rights and environmental disputes, resources arbitrations in Asia and Africa, the Boeing and Airbus disputes in the World Trade Organization, utilities disputes in Eastern Europe, and IP disputes against China. Jo has also negotiated or advised on all of Australia's investment and trade treaties, including with the US, UK, EU, Canada, Chile, Mexico, China, Japan, South Korea, India, ASEAN, Singapore, Malaysia, and Vietnam. Jo is co-Chair of the Australian Law Council Trade and Business Law Committee, is recognised by LawDragon 500, and sits on the Australian Expert Advisory Committee for UNCITRAL.
