Avoiding disputed procurement processes – lessons from recent cases and practical experience

Norton Rose Fulbright is delighted to invite you to the next webinar in our NSW Government breakfast roundtable series for General Counsel and Government leaders. Our seminar series is focused on the latest challenges and issues facing government personnel in professional and leadership roles.
 
In this session we will provide insights into, and practical tips for, managing procurements including safeguarding agencies from potential legal issues or disputes arising from disputed procurement processes. This will include discussion about the complaint processes and powers of the Court introduced by PBD-2019-05 Enforceable Procurement Provisions (EPP Direction), which applies to certain ‘covered’ procurements by departments and agencies listed in Schedule 1 of the EPP Direction. As there is limited case law for agencies to understand the scope of their obligations under the EPP Direction, we will share some of our experiences in procurement appeal cases including considering recent decisions in other jurisdictions. 

The topics we will cover include:

  • Update on the NSW Legislative Council’s inquiry into “Procurement practices of government agencies in New South Wales and its impact on the social development of the people of New South Wales” and interim findings.
  • How to deal with key obligations and disputes under the EPP Direction and identify and mitigate legal risks associated with procurements covered by the EPP Direction.  
  • Procurement appeals in NSW and abroad: Round up of recent cases from the last 24 months and lessons for NSW Government.
