Autumn Franchising Intensive - Day 2
These webinars have now passed
The Intensive has a strategic focus.  We will outline the key issues for CEOs, legal counsel and senior management in 2021, and share our views on the regulatory and economic landscape.

With tougher economic conditions and an uplift in disputes we will provide our thoughts on effective dispute management, how to deal with group claims, what arbitration might mean in a franchising context and why litigation funders are currently interested in franchising.

We’ll share why and how brands have to adapt to new technologies, regulation and customer preferences, and discuss a number of other legal issues currently impacting our franchisor clients. Please click here to view our complete program.

Sessions

Key trends in franchising disputes
Presenters
  • Nigel Jones, Partner
More uncertain times, and the likely need to implement network change, will increase the risk of major franchising disputes.  As franchise brands grow in value, this success can spark the interest of the media, plaintiff lawyers and litigation funders. Nigel Jones will discuss the key trends that we have observed over the past 12 months in dealing with franchise disputes. This will involve discussion of the key types of disputes that have arisen, best practice for handling disputes, why litigation funders are interested in franchising, the current status of franchise class actions and strategies for reducing franchising disputes.
Data and privacy in franchise network
Presenters
  • Peter Mulligan, Partner
  • Maija Kerry, Partner
Data breaches are an increasing risk for all organisations, particularly for those organisations that are consumer-facing. Although franchisees are often responsible for the safeguarding of customer information, any data breach or security issue will have significant implications for the franchisor. Consumers are highly attuned to the need to protect their personal information, and there are significant brand, legal and reputational risks associated with any data breach or security incident. Peter Mulligan and Maija Kerry will work through a case study to demonstrate some key risks for franchisors in connection with customer data and data breaches. We will also provide some practical tips for the protection of customer information and data in the context of franchise operations.
Developments in employment and WHS laws for franchisors
Presenters
  • Mathew Webster, Special Counsel
  • Helene Lee, Partner
Mathew Webster and Helene Lee will discuss the latest issues in employment and WHS laws impacting franchisors. We will provide an update on underpayment issues, enforcement action by the FWO and other employment issues arising from COVID 19.
