Start your morning with coffee and compelling conversation, as we explore the tension between cross-border insolvency and arbitration in the Asia-Pacific region. This panel brings together experts in both arbitration and insolvency to unpack the challenges that arise when these two areas of practice intersect.

Aimed at arbitration lawyers and insolvency specialists alike, this event will offer fresh insights and real-world examples to kickstart day 3 of Australian Arbitration Week. Coffee and breakfast will be served from 7:30am.

Panellists are The Honourable James Allsop AC, Scott Atkins (Partner and Global Head of Restructuring, Norton Rose Fulbright), Emily Tillett (Vice President, Burford Capital Hong Kong), and Kei-Jin Chew (Managing Director, Ascendant Legal Singapore). Using the High Court’s landmark decision in CBI Constructors v Chevron as a springboard, this session unpacks how tribunals are navigating procedural objections, court intervention in arbitration, and what this means for parties moving forward. Whether you're a lawyer, an arbitrator, or just arbitration-curious, this is one you won’t want to miss.

Upon conclusion of the panel discussion, we invite you to continue the conversation over drinks and canapés.

Speakers

The Honourable James Allsop AC has over 40 years of experience in commercial law, having practiced across several jurisdictions in numerous substantive areas. His esteemed judicial career includes appointments as the former Chief Justice of the Federal Court of Australia, the President of the New South Wales Court of Appeal, and currently as a non-permanent judge to the Hong Kong Court of Final Appeal and a judge of the Singapore international Commercial Court. Mr Allsop has extensive experience as an advocate and facilitator of international ADR, particularly in the Asia-Pacific region having been appointed as Chairman in various HKIAC and ACICA arbitrations. He is appointed to the Singapore International Arbitration Centre’s Panel of Arbitrators, the Dubai International Arbitration Centre’s List of Arbitrators and is a member of the Asian International Arbitration Centre’s Panel of Arbitrators and Mediators. Mr Allsop has also held various academic position, including as the Challis Lecturer in Bankruptcy and Insolvency at the University of Sydney from 1985 to 1992.

Scott Atkins, Partner and Global Head of Restructuring, Norton Rose Fulbright
Scott Atkins serves as global head of restructuring, and head of the Australian risk advisory practice. In 2023 he was the global chair of Norton Rose Fulbright.

Scott is an internationally acclaimed industry leader in restructuring and insolvency, as well as risk, governance and complex litigation. He has more than 25 years'     of industry experience and is based in Sydney.

Scott has one of the most reputable restructuring and insolvency practices in the Asia-Pacific, having been recognised as Australia's only Eminent Practitioner for this category in the Chambers and Partners regional legal rankings for each of the last three years. Scott's gravitas and deep industry knowledge, experience and insights see him shape the global policy and regulatory agenda in the restructuring and insolvency industry and act on some of the most high-profile and precedent setting insolvency matters in the world.  

Emily Tillett, Vice President, Burford Capital Hong Kong
Emily Tillett is a Vice-President at the leading litigation finance company Burford Capital. Emily leads Burford’s investment activities and operations in Hong Kong and supports its business in the APAC region. Burford is the world’s largest provider of commercial legal finance with public listings on the New York Stock Exchange and London Stock Exchange and offices in the US, Europe, Asia and the Middle East. Emily is a Hong Kong, New Zealand and Australian qualified lawyer and immediately prior to joining Burford she was Counsel in the disputes resolution team at Allen & Overy in Hong Kong.

Kei-Jin Chew, Managing Director, Ascendant Legal Singapore
Kei-Jin has more than 30 years’ experience as a dispute resolution lawyer based in Singapore. He specialises in commercial litigation and international arbitration. He is appointed to the Singapore International Arbitration Centre specialist panel of arbitrators for insolvency disputes and is also a Fellow of the Singapore Institute of Arbitrators. Kei-Jin is qualified as an Advocate & Solicitor of Singapore and a member of the Bar of England & Wales and is also recognised by Lexology Index: Commercial Litigation 2025 as being among Singapore’s leading commercial litigators and is “Recommended” for both Arbitration and Commercial Litigation.

Ananya Mitra is an international arbitration lawyer based in Sydney. Ananya is admitted to practice in India and is a Fellow of the Singapore Institute of Arbitrators (SIArb).

‘Incredibly hard working and always helpful and super responsive’ and ‘strong for India-related disputes and investor-state arbitration’ (Legal 500 (2022)), Ananya’s practice includes complex, high-value commercial and investment treaty arbitration with a focus on the energy sector (piped gas, LNG, renewables), pharmaceuticals, joint venture and shareholders disputes, and India-related matters.

Tamlyn Mills, Partner, Norton Rose Fulbright
Tamlyn Mills is an experienced dispute resolution practitioner with a broad practice encompassing commercial and corporate litigation, international arbitration and related court proceedings, including the enforcement of arbitral awards and foreign judgments in the Australian courts. Tamlyn has a specialist focus on international arbitration and has acted as counsel to a range of clients in foreign seated arbitrations under the major arbitral rules as well as in domestic ad hoc arbitrations, including undertaking oral advocacy and the examination of witnesses. 

Callista Harris, Barrister, 7 Wentworth Selborne Chambers
Callista is a barrister at 7 Wentworth Selborne in Sydney and an associate member of 3 Verulam Buildings in London. She specialises in international arbitration and appears as counsel before domestic courts and international courts and tribunals 

Daisy Mallett, Legal Counsel and Independent Arbitrator, Mallett Law 
Daisy Mallett is an independent arbitrator and legal adviser.  
Daisy was named "Arbitrator of the Year" in 2025 by the Australian Disputes Centre and has received multiple arbitrator appointments by each of the ICC, HKIAC, SIAC and ACICA, including in several expedited arbitrations.  Daisy has experience as sole arbitrator and chairperson of tribunals.  

Daisy has over twenty years of experience as an international arbitration specialist.  She was formerly a partner at King & Wood Mallesons, where she led the international arbitration practice.  As partner, she acted as counsel on high-stakes commercial and investor state arbitrations, advising multinational companies and governments in relation to their most complex risks and disputes.  
Daisy is routinely recognised by leading legal industry publications, including being listed in the Legal 500 “Power List”, Who’s Who Legal/ Lexology. and Chambers & Partners.   

Daisy has been an active participant in professional committees relating to international arbitration throughout her career. She is current chair of the Sustainability Taskforce of ACICA, a member of the Steering Committee of ICC Australia, and was formerly a Member of the Board of Directors of ACICA, Chair of the NSW Training Committee of ACICA, a member of the Law Council of Australia’s Transnational Litigation Committee, a member of the New South Wales Law Society’s Alternative Dispute Resolution Committee.

Kent Phillips, Partner, Norton Rose Fulbright 

Kent Phillips is a dispute resolution lawyer based in Singapore. He is a highly regarded senior dispute resolution lawyer with more than 20 years of experience conducting arbitrations under leading institutional rules in all of the major seats, under both civil and common applicable laws.

Kent regularly advises clients on complex and high-value commercial disputes across our clients' key sectors and jurisdictions, including those related to the infrastructure, natural resources and energy sectors in Southeast Asia and India.

Alan de Rochefort-Reynolds, Senior Associate, Norton Rose Fulbright  
Alan de Rochefort-Reynolds is a dispute resolution lawyer whose practice focuses on international arbitration and cross-border disputes. He also regularly acts in complex, high-value litigation.

Alan’s international arbitration practice includes investor-State disputes and international commercial arbitrations. He has acted for and against States,and has particular interest in investment contracts. Alan also regularly advises on corporate structuring, investment treaty protections, human rights and business, as well as export controls and sanctions. He also has experience advising on and drafting inter-State agreements.
